Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Beatin The Bookie LLC ("Company," "we," "us," or "our"), the operator of the websites and tools offered under the brands BTB Sports Intelligence and Rise Above EV, including the sites at beatinthebookie.com and riseaboveev.com, and their subdomains (together, the "Service").
By creating an account, entering an access code, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is (and is not)
The Service is an analytics and information product. We publish data, models, projections, statistical estimates, and lineup-building tools for fantasy sports and sports-related markets.
The Service is not a sportsbook, a fantasy contest operator, an investment adviser, or a licensed gambling operator. We do not:
- accept, place, or facilitate any bet or wager;
- hold, transmit, or manage any user funds;
- guarantee any outcome, result, or profit;
- provide betting, financial, tax, or legal advice.
Everything on the Service is for informational and entertainment purposes only. Any decision you make using our information, including whether to enter a fantasy contest or place a wager elsewhere, is your own decision and your own responsibility. See our Disclaimer for more.
2. Eligibility
To use the Service you must:
- be at least 18 years old, or the age of majority in your jurisdiction, whichever is greater;
- be accessing the Service from a jurisdiction where doing so, and any activity you undertake with our information, is legal;
- provide accurate account information and keep it current.
You are solely responsible for determining whether your use of the Service and any related fantasy or wagering activity is legal where you are located. The Service is intended for users in the United States; we make no claim that it is appropriate or available elsewhere.
3. Your account and access
Some features require an account (created by verifying your email) or a shared access code. You are responsible for all activity under your account or access code and for keeping your login and any access code confidential.
One account is for one person. You may not share, sell, sublicense, or transfer your account or access code, and you may not pool a single subscription or access code across a group beyond what we expressly permit. We may suspend or terminate accounts or access codes that appear to be shared, resold, automated, or otherwise abused.
4. Subscriptions, billing, and cancellation
Some parts of the Service may be offered free, on a promotional or introductory basis, or as a paid subscription.
- Free or promotional access. We may offer all or part of the Service free for a limited time or on a promotional basis. We may change, limit, or end free access at any time. We may take reasonable steps to prevent one person from repeatedly claiming access intended to be granted once.
- Paid subscriptions. If you buy a subscription, you authorize us and our payment processor to charge the price and any applicable taxes shown at checkout. Unless stated otherwise, subscriptions renew automatically at the end of each term at the then-current price until you cancel.
- Price changes. We may change prices. We will give notice of a price change before it applies to your next renewal, and the change takes effect on your next billing cycle.
- Cancellation. You may cancel at any time through your account or by contacting picks@beatinthebookie.com. Cancellation stops future renewals; it does not retroactively refund the current term unless required by law or stated in our refund policy below.
- Refunds. All sales are final and payments are non-refundable except where required by law.
- Failed payments. If a charge fails, we may suspend paid features until payment is resolved.
Payments are processed by Stripe and are also subject to Stripe's terms.
5. Acceptable use
You agree not to:
- scrape, crawl, harvest, or bulk-download data or content from the Service, or access it by any automated means, except as we expressly allow;
- resell, redistribute, republish, or commercially exploit our data, projections, picks, or content;
- reverse engineer, decompile, or attempt to derive our models or source code;
- circumvent, disable, or interfere with access controls, gates, rate limits, or security;
- upload malicious code or attempt to disrupt, overload, or gain unauthorized access to the Service or its infrastructure;
- use the Service to break any law, or to facilitate gambling by anyone underage or in a jurisdiction where it is prohibited;
- misrepresent your identity or affiliation.
6. Intellectual property
The Service, including our data compilations, projections, models, text, graphics, logos, and software, is owned by the Company or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved.
"BTB Sports Intelligence," "Beatin The Bookie," "Rise Above EV," and associated logos are our marks. You may not use them without our prior written permission.
7. Third-party data, brands, and links
The Service uses and references data and marks owned by third parties, including sports leagues, teams, players, statistics providers, and daily fantasy operators such as DraftKings. We are not affiliated with, endorsed by, or sponsored by any of them. Third-party names and marks are the property of their owners and are used for identification and informational purposes only. Third-party data may be delayed, incomplete, or inaccurate, and we are not responsible for it.
The Service may link to third-party sites we do not control. We are not responsible for their content, terms, or privacy practices.
8. Disclaimers
THE SERVICE, INCLUDING ALL DATA, PROJECTIONS, MODELS, AND CONTENT, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY PROJECTION, ESTIMATE, OR "PICK" WILL BE ACCURATE OR PROFITABLE. PAST PERFORMANCE DOES NOT GUARANTEE OR PREDICT FUTURE RESULTS. YOU USE THE SERVICE, AND MAKE ANY FANTASY OR WAGERING DECISION, AT YOUR OWN RISK.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, OPERATORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, WINNINGS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless the Company and its owners, operators, and suppliers from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, including for violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) survive.
12. Changes to the Service and these Terms
We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use after changes take effect means you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules.
The state and federal courts located in Laramie County, Wyoming will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to venue there.
